Governor Walz signed HF 114 (Moller)/SF 303 (Johnson) into law on February 12th. The bill clarifies the impact of legislation passed in March 2020 that suspended statutory deadlines, including statutes of limitations, during the Peacetime Emergency declared on March 13, 2020.
Under the bill, any deadline or statute of limitation that would have expired during the suspension period will not expire until April 15, 2021. However, any deadline or statute of limitation that was not set to expire until after April 15, 2021 is not extended by the suspension. In other words, no one will lose their day in court because of the Covid pandemic, but no one will gain additional time to bring an otherwise valid claim after April 15, 2021 simply because the pandemic struck during the respective time limit. The bill was sponsored by the Bar Association.
